Advertiser Terms and Conditions

 These Terms and Conditions set out the basis on which you (“the advertiser”) will be permitted to register with and use www.locationinternational.net (“our site”).  Your full acceptance of and compliance with these Terms and Conditions is an essential requirement of our contract with you.  By registering with our site and/or by using our site in any way as an advertiser, you are indicating your irrevocable acceptance of these Advertiser Terms and Conditions.

Contracting parties

The contract created by these Terms and Conditions is between us and the advertiser only.

We are LocationInternational Limited, a UK limited company registered under company number 07178527 with its registered office at 120 Cavendish Place, Eastbourne, East Sussex, BN21 3TZ, England.

 The advertiser is the individual or entity specified by the advertiser when registering with our site.  The advertiser confirms that the advertiser details, including where applicable the advertiser company registration number, address and contact details provided to locationinternational on registration are correct and that the advertiser is free to enter into these Terms and Conditions.

Eligibility to advertise on our site

You must be a bona fide regulated estate agent (or the equivalent in your country) to advertise on our site.  We do not accept property adverts directly from property owners or from unregulated individuals or businesses.

You may advertise on our site from most locations in the World.  Please do not do so if there is any legal or regulatory prohibition in your location which might restrict your use of this site as permitted under these Terms and Conditions.  We cannot be responsible for any consequences of your use of our site contrary to local applicable law and regulation.

Placing and deletion of advertisements

As a registered user, you shall be entitled to post advertisements for property on our site by completing the specified information fields available.  We may change the format, display and information contained in our property advertisements at any time. 

Log in details and passwords

All log in details and passwords for your advertisement are your responsibility.  Please let us know if your log in details have been misused.  We suggest that you change your password regularly.

Payment for and duration of advertisements

When you create an advertisement on our site, you will need to select a period for which the advertisement should be displayed on the site.  Payment is required to be made online in advance for that period before we will display the advertisement.  The advertisement will be deleted automatically at the end of the period for which payment has been received if the advertisement has not been renewed. You may extend the advertising period at any time if required by paying a further fee online.  We will endeavour to send you an e-mail in advance to notify you of the forthcoming expiry of an advertisement. 

Cancellation of an advertisement

You may delete an advertisement before the expiry date if you choose to do so, for example where the property in question has been sold or withdrawn from the market.  Simply follow the online instructions to do this.  The advertisement is not transferable to any other property and payments already made are non-refundable.

Advertising standards

You warrant and undertake to ensure that the information shown on our site is true, accurate and not misleading.  We do not take any responsibility for the factual accuracy of the information supplied by advertisers for publication in an advertisement.  We also reserve the right to delete advertisements for any reasonable reason at our discretion if we consider that it does not meet advertising industry standards.

In addition, we reserve the right to remove any advertisement or other content from our site if there is reason to believe that the same:

a)               contains false or misleading information;

b)               has been posted maliciously; or

c)               for any other reason which may affect the reputation, credibility and/or legal or regulatory compliance or liability of our site.

We reserve the right to inform the legal or regulatory authorities in the country concerned, and any other country, of any information that will identify the poster in the event that we consider there to have been any breach of the applicable law.

Translation and display of advertisements

We use all reasonable efforts to ensure that the advertisements on our site are of a good quality.  An important feature of our site is that we can display the advertisements in multiple languages by using automatic translation facilities.  We do not individually translate each advertisement and therefore minor mistakes in translation can arise for which we are not liable.  Difficulties can also arise in the display of uploaded files, such as images of properties, in particular due to the file type used and the size of the file.  The following file types should be used for your image files: maximum size 2MB (smaller sizes recommended for speed of uploading); file extensions, png gif jpg jpeg.

Copyright in your advertising materials

By creating and submitting any content to our site for publication, the advertiser is confirming that:

a)               the advertiser owns full title to any such photographs or images, and/or has the permission of the owner of the title to use them in the advertisement;

b)               the advertiser agrees to grant a copyright licence to us for their use on our site;

c)               the advertiser agrees to indemnify us and hold us harmless in respect of any claims against, and expenses incurred by us in respect of any breach of copyright.

Consent from property owner and regulatory clearance

By creating and submitting any content to our site for publication, the advertiser is confirming that:

a)               the advertiser has the permission of the owner of the property to advertise that property;

b)               the advertiser agrees to us publishing the advertisement;

c)               the details supplied by the advertiser are true, accurate and not misleading and are in accordance with fair trade practises;

d)               the advertiser is entitled to advertise property for sale or rent in the manner facilitated by our site without any legal or regulatory restriction;

d)               the advertiser agrees to indemnify and hold us harmless in respect of any claims against, and expenses incurred by us in respect of any breach of this clause.

Enquiries from site users about property or for services related to property

It is the responsibility of the advertiser to respond to enquiries from potential clients in a prompt, professional and courteous manner.  The advertiser’s contact information is shown next to the advertisement to enable respondents to an advertisement to contact the advertiser directly. It is not part of our service to respond to enquiries resulting from advertisements on our site, or to pass on information to advertisers following such enquiries.  We accept no responsibility for losses that may result from  our not doing so.

Our intellectual property

Our site and its content are protected by intellectual property rights, including but not limited to copyright and trade marks. Except as expressly authorised by us or relevant third parties, you may not copy, download, adapt, alter, modify, rent, lease, loan, sell, distribute, communicate or make available to the public or create derivative works of any content of our site, in whole or in part.  Neither may you create a link from any other website to any part of our site except the home page of our site.

Privacy and security of data

The details supplied by the advertiser upon registration for advertising property have been requested to ensure that advertisers are bona-fide businesses. These details are held on a database which we use reasonable measures to keep secure.

The advertiser details that are shared with visitors to the locationinternational websites are those that the advertiser chooses to display in the advertisements on our site and under the heading “To Contact Agent”.  These contact details consist of the advertiser’s name, website address, the contact telephone number or numbers supplied, the name of the particular person to contact (if any) and the e-mail address or addresses supplied.

No other information supplied by advertisers to locationinternational will be shared or with or sold to any other organisation, except upon the request of governmental, legal or regulatory authorities in the United Kingdom.

Liability for losses resulting from malfunctioning of software or unavailability of our site

We do not accept any liability for any losses to you arising due to the malfunctioning of our software or the unavailability of the site.  We use all reasonable endeavours to ensure that the our site is professionally hosted in a secure environment.  It is in the commercial interest of both us and you to ensure that our site is available and functions correctly at all times. However, we accept no liability for any interruption in service; loss of some or all site facilities; criminal hacking or unauthorised intrusion into the site; loss of data at any time; special, consequential or indirect losses of any kind.

General Disclaimers

a)               Your use of our site is at your sole risk. The site is provided on an “as is” and “as available” basis and we do not guarantee that the site will be suitable for your purposes and requirements.

Termination

a)               you have breached these Terms and Conditions and have failed to comply with our request for you to remedy such breach (if it is capable of breach) within the time notified to you; or

b)               you become insolvent or bankrupt or proceedings are initiated in this regard against you, you cease or threaten to cease trading or are unable to pay your debts as they fall due.

Changes to these Terms and Conditions

We may make changes to these Terms and Conditions at any time by posting revisions on our site.  Any such changes shall take effect automatically 14 days after the date on which they are posted by us.  Changes shall not affect the price or duration of any advertisement already paid for by you by the time that such changes take effect.  Please review these Terms and Conditions regularly.  Your continued use of our site after any changes have been posted to the site constitutes your full acceptance of them.  If you do not accept our changes, you must not make any further use of our site.

General Legal Matters

a)               These Terms and Conditions in addition to the Terms of Use and Privacy Policy on our site together constitute the entire agreement between you and us.

b)               Any failure by us to exercise or enforce any part of these Terms and Conditions shall not mean that we have waived our rights to do so in the future.

c)               If at any time any provision of these Terms and Conditions is or becomes illegal, invalid or unenforceable in any respect that shall not affect the legality or validity or enforceability of any other provision.

d)               The Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms and Conditions.

e)               These Terms and Conditions and the relationship between you and us shall be governed by the laws of England and Wales and both parties agree to submit to the exclusive jurisdiction of the English courts.

Site Objectives:  The main purposes of our site are (a) to provide a convenient means for owners of property, through their agents to advertise properties for sale or to rent; (b) to provide property advertisements in a range of languages; (c) to provide general information and editorial in relation to international property.  Our site may also publish other information and provide other services which we consider to be complementary to our core purposes from time to time.

Advertisers:  We do our best to ensure that the advertisers using our site are bona fide regulated estate agents.  However, we are not able to verify them or to warrant that they are authorised or regulated to advertise properties for sale.  In the event that we find out or alerted that any advertiser of property is not a bona fide regulated estate agent we shall investigate this and take remedial action if necessary, which shall principally be to correct or delete the information about the advertiser on the site.

General website usage permissions:  Any rights not expressly granted in these Terms of Use are reserved.  LOCATIONINTERNATIONAL is our trade mark and you may not make any use of it without our written permission.  Provided that you comply fully with these Terms of Use, we permit you to use our (or our licensors’) intellectual property published on our site for the purposes of accessing, printing and downloading extracts from our site for your own private non-trade use on the following basis:

• no documents or related graphics on our site are modified in any way;
• no graphics on our site are used separately from the corresponding text; and
• our copyright and trade mark notices and this permission notice appear in all copies.

Copyright and database rights: Unless otherwise stated, the content on our site contains material which is protected by copyright and other intellectual property rights.
